The Competition Commission and the Independent Broadcasting Authority sign a MoU

A Memorandum of Understanding (MoU) was signed between the Competition Commission (CC) and the Independent Broadcasting Authority (IBA), on 10 May 2023. The signing ceremony took place at the seat of the Competition Commission, in Port-Louis.

The MoU sets out a framework of cooperation between the CC and the IBA, as provided under Section 66 of the Competition Act 2007, for the exercise of their respective responsibilities. It also establishes a mechanism for practical cooperation in the exercise of those responsibilities, including the use of the expertise of the IBA in respect of investigations under the Competition Act in relation to broadcasting matters.

In a statement, Mr Deshmuk Kowlessur, Executive Director of the CC, highlighted that

“it is important for regulatory bodies to collaborate with each other not only to ensure policy consistency but to bring synergy in enforcement of their respective mandates. This MoU consolidates the basis to further the existing collaboration with the IBA for enhanced enforcement of competition policy in the broadcasting sector. We will work in close collaboration with the IBA to ensure that broadcasting markets are not being artificially distorted by enterprises and that they operate for the betterment of consumers and the economy at large.”

Mr Kaveeraj Ramphul, Acting Director of the IBA, further underscored that

“one of the objectives of the IBA is to ensure fair competition among broadcasting licensees. In a broader sense, the Competition Commission also shares a similar mission and it is, therefore, beneficial for both institutions to collaborate fully. This MoU will, inter alia, enable us to collaborate in dealing with anticompetitive behaviours within the radio and television broadcasting industry. Surely, this MoU will be a success and it is just the beginning of mutual collaboration between our two organisations.”
